Fabricant LLP secures a major victory in its patent infringement campaign against Google, Samsung, and Waze.
Today, Fabricant LLP secured a major victory for its client AGIS Software Development in its patent infringement campaign against Google, Samsung, and Waze. AGIS Software Development LLC defeated four Petitions for Inter Partes Review filed by Google and Samsung in their latest patent office challenge to AGIS’s patent portfolio. Google and Samsung’s petitions, IPR Numbers IPR2020-000870, IPR2020-000871, IPR2020-000872, and IPR2020-000873, were denied in the PTAB’s discretion under Fintiv.
The PTAB stated that the record shows that Google and Samsung “delayed filing the Petition without any excuse for the delay and, therefore, bears significant responsibility for the fact that the district court and the parties have expended effort in preparing for the upcoming trial that will address issues that substantially overlap with those raised in the Petition.” No Patent Office challenges remain for AGIS’s U.S. Patent Nos. 9,820,123, and 9,749,829 and Google and Samsung are now time barred from further challenges.
