Intellectual Property Litigation
Joseph Mercadante is an experienced patent litigator with a focus on cases in the field of electronics, including computer hardware and software, automotive technologies, telecommunications and networking, and semiconductors. He represents both plaintiffs and defendants in all aspects of patent litigation including pre-suit investigations, validity and infringement analyses, Markman proceedings, expert reports and depositions, all forms of motion practice, and trial. In addition to practicing in federal courts across the country as well as the International Trade Commission, he has substantial experience at the Patent Office, including both inter partes review and reexamination proceedings. He also regularly counsels clients regarding the acquisition of intellectual property.
Joseph served as a law clerk to Chief Judge Garrett E. Brown. Jr. (Ret.) of the United States District Court for the District of New Jersey and has significant technical experience including a background in electrical engineering.

Successfully represented an LED manufacturer in patent litigation and inter partes review in an 11-patent case regarding LED replacements for fluorescent tubes.

Successfully defended an automobile manufacturer In multiple patent infringement lawsuits and inter partes review proceedings regarding automotive cruise control. passenger restraint engine control, lighting, and navigation technologies.

Successfully defended a consumer electronics company in patent litigation and related reexamination related to CMOS image sensors.

Represented a closely-held corporation in patent, copyright and trade secret regarding telephone routing technology. Successfully invalidated the asserted patent in district court.
